Terms of service
These terms apply when you use Real Agent Marketing (ABN [YOUR ABN]) ("we", "us"), including our website, dashboard, the websites and digital business cards we publish for you, and domains we register for you. By creating an account you agree to them.
1. The service
We provide tools to create and publish a personal website and digital business card for real estate agents, register and connect domains, and, where agreed, online marketing services. Features available to you depend on your plan.
2. Your account
You need to be a licensed or registered real estate professional in Australia, or working under one, to publish a website with us. Keep your sign-in details secure; you're responsible for activity on your account.
3. Your content and responsibilities
- Accuracy. You're responsible for everything published on your website and card, including copy we draft for you that you approve. Check it before you publish.
- Facts and claims. Only publish facts, figures and reviews that are true and that you can substantiate. Don't publish misleading or deceptive claims.
- Licensing and advertising rules. You're responsible for meeting the real estate licensing and advertising requirements in your state, including identifying your licensee.
- Brand permission. If you choose a co-branded design, you confirm you have your agency's permission to use its name, logo and colours.
- Images and listings. Only upload or link to photos, logos and listing content you have the right to use.
You keep ownership of your content. You give us a licence to host, display and adapt it as needed to provide the service.
4. AI-drafted content
We use AI to draft website copy from your brief. Drafts can contain mistakes. They're a starting point for you to review, edit and approve, not professional advice.
5. Domains
Domains are registered in your name as the registrant, through our registrar partner, and are subject to the rules of the relevant registry, including auDA's licensing rules for .au domains. You must provide accurate registrant details and meet eligibility requirements. You can transfer your domain to another provider at any time. Renewal is your responsibility unless your plan includes it.
6. Fees
Plan fees are shown on our pricing page in Australian dollars, including GST. Fees, billing periods and any cancellation terms are confirmed when you choose a paid plan. Google Ads spend is paid to Google and is separate from our fees.
7. Acceptable use
Don't use the service to publish unlawful, misleading, defamatory or infringing content, to send spam, or to interfere with the service or other users. We may remove content or suspend accounts that breach these terms.
8. Availability
We aim to keep the service and your website available at all times, but we can't guarantee uninterrupted access. We may change or improve features over time.
9. Search results
We build every site to be found by search engines, but we don't control search engine rankings and don't guarantee any particular position in search results.
10. Our liability
Nothing in these terms excludes rights you have under the Australian Consumer Law that can't be excluded. To the extent the law allows, our liability for any claim relating to the service is limited to supplying the service again or paying the cost of having it supplied again, and we aren't liable for indirect or consequential loss.
11. Ending your account
You can close your account at any time. When you do, we'll stop hosting your website. Your domain remains registered to you until it expires, and you can transfer it to another provider.
12. Changes to these terms
We may update these terms. If a change materially affects you, we'll let you know by email before it takes effect.
13. Governing law
These terms are governed by the laws of [STATE], Australia.
